PostLife Terms of Service

Effective Date: April 16, 2025

Welcome to PostLife. These Terms of Service ("Terms") govern your access to and use of the services offered by PostLife ("PostLife", "we", "us", "our") through the website www.postlife.info (the "Service").

PLEASE READ THESE TERMS CAREFULLY. BY REGISTERING FOR OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. If you do not agree with these Terms, you may not use the Service.

1. Service Description

PostLife allows you to create and store digital messages (text and potentially attachments in the future) intended to be delivered to designated recipients after your prolonged absence (due to death or permanent incapacity) has been verified through a periodic check-in system and confirmation by your designated Trusted Contacts.

Important: PostLife is a posthumous communication tool and NOT a substitute for a legal will, trust, power of attorney, estate planning, or legal or financial advice. We do not provide legal advice or guarantee the legal validity of instructions contained in your messages.

2. User Accounts

  • Registration: You must register for an account by providing accurate and complete information (name, valid email, secure password). You are responsible for maintaining the confidentiality of your password. You must be at least [Minimum Age, e.g., 18] years old to use the Service.
  • Verification: You must verify your email address to activate your account.
  • Security: You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. User Responsibilities

  • Accurate Information: You are responsible for the accuracy of all information provided, including your own information, that of your Trusted Contacts, and that of your message recipients.
  • Check-ins: You are responsible for performing periodic check-ins based on the frequency you configure to keep your account active and prevent the verification process from starting.
  • Trusted Contacts: You are responsible for carefully selecting your Trusted Contacts, obtaining their consent (implicit or explicit) to designate them, and keeping their contact information updated on the platform. You must inform them about their role and how the process works.
  • Message Content: You are solely responsible for the content of the messages you create and store. You grant PostLife a limited, worldwide, non-exclusive license to store, encrypt, transmit, and deliver your messages to the designated recipients solely under the conditions specified in these Terms.
  • Acceptable Use: You agree not to use the Service for any illegal or prohibited purpose. You may not store or send content that is defamatory, obscene, threatening, harassing, hateful, illegal, infringes on copyrights, or violates the privacy of others. We reserve the right to suspend or terminate accounts that violate this policy.

4. Trusted Contacts

  • Role: Trusted Contacts are designated by you to help verify your status if you stop performing check-ins. Their role is limited to responding to our verification request.
  • No Access to Messages: Trusted Contacts will never have access to the content of your stored messages.
  • Cooperation Not Guaranteed: While we hope Trusted Contacts will cooperate, PostLife cannot guarantee that they will respond to our verification requests or the accuracy of their response. The verification process depends on their voluntary participation.

5. Message Content and Encryption

  • Ownership: You retain intellectual property ownership of the messages you create.
  • Encryption: We implement reasonable security measures, including server-side encryption for the subject and body of your messages before storage, to protect them from unauthorized access. See our Privacy Policy for more details.
  • No Review: PostLife does not monitor, edit, or review the content of your messages. We are not responsible for the accuracy, legality, or appropriateness of the content you store or send.

6. Verification and Delivery Process

  • Check-in and Grace Period: If you fail to check in within the configured timeframe, you will enter a grace period. We will send reminders (if you have this option enabled).
  • Alert to Contacts: If the grace period expires without a check-in, we will notify your designated Trusted Contacts, requesting verification of your status.
  • Confirmation: Delivery of your messages marked as "Ready" will only begin if one or more of your Trusted Contacts actively confirm your death or permanent incapacity through the secure link provided.
  • Delivery Attempts: PostLife will attempt to deliver messages to the email addresses of the recipients you provided. However, we cannot guarantee delivery due to factors beyond our control (spam filters, incorrect or inactive email addresses, recipient server issues, etc.).

7. Fees and Payments (Right Reserved)

Currently, PostLife is offered for free. We reserve the right to introduce paid subscription plans, fees for premium features (such as attachments or increased storage), or change the limits of the free plan in the future. Any changes to fees will be communicated with reasonable advance notice. If we introduce paid services, additional payment terms will apply.

8. Intellectual Property

The Service and all its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of PostLife and its licensors.

9. Advertising

We reserve the right to display advertising within the Service or send promotional or marketing communications by email to users who have consented to receive them. You can manage your communication preferences and opt out of marketing emails as described in our Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. POSTLIFE DOES NOT WARRANT THAT THE SERVICE WILL OPERATE UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED; THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. WE DO NOT GUARANTEE THE TIMELY OR SUCCESSFUL DELIVERY OF ANY MESSAGE OR THE RESPONSE OR ACCURACY OF VERIFICATION BY TRUSTED CONTACTS.

11. Limitation of Liability

IN NO EVENT SHALL POSTLIFE, NOR ITS DIRECTORS, EMPLEADOS, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

12. Indemnification

You agree to defend, indemnify, and hold harmless PostLife and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not to limited to attorneys' fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) the Content you store or send through the Service.

13. Termination

You may stop using the Service and close your account at any time through your settings or by contacting us. We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will cease immediately, and we will proceed to delete your data in accordance with our Privacy Policy and applicable law.

14. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Province of Quebec, Canada, without regard to its conflict of law provisions.

16. Language

These Terms may be translated into other languages. In the event of a conflict between the English version and any translation, the English version shall prevail.
